Kato Creations ("we," "us," "our") sells lifestyle and gift products to customers in the United States.
1. Agreement to these terms
By accessing or using katocreations.com (the "Site") or placing an order, you agree to these terms and our Privacy Policy. If you do not agree, do not use the Site. Our Returns & Refunds Policy and Shipping Policy also form part of these terms.
2. Eligibility and acceptable use
You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method you choose. If you order on behalf of an organization, you confirm that you are authorized to bind it.
You may not use the Site unlawfully; place fraudulent orders; interfere with the Site's operation or security; attempt unauthorized access; introduce malicious code; impersonate another person; use automated tools to scrape, copy or monitor the Site without our permission; or resell products in a way that misrepresents your relationship with us. We may suspend access to the Site or cancel orders where these terms are breached.
3. Product information, images and availability
We aim to present descriptions, specifications, images and prices accurately. Some product photos include digitally generated lifestyle scenes to show scale and style. Actual color, finish and size may vary slightly from images because of lighting, screen settings and the nature of visualizations. The specifications stated in the product listing (such as dimensions, materials and finish) govern. A difference between a product and a lifestyle scene is not by itself a fault. If a product does not match its listed specifications, it is treated as an incorrect item and you are entitled to a refund or replacement under our Returns & Refunds Policy.
Products are subject to availability. Placing an item in your cart does not reserve it. We may correct errors or omissions in product information at any time.
4. Care and use
Please follow any care instructions included with your product, such as washing guidance for drinkware and handling guidance for printed items. To the extent permitted by law, we are not responsible for loss or damage caused by use that does not follow the included instructions.
5. Orders, pricing and payment
Prices are shown in US dollars. Shipping is free on every order with no minimum spend. Any applicable sales tax is shown at checkout before you pay. Your order is an offer to buy. Our order confirmation email confirms that we received your order; it is not acceptance. A contract is formed when we dispatch the product and send you a shipping confirmation.
We may decline or cancel an order where permitted by law, for example if a product is unavailable, if there is a pricing or listing error, or if we suspect fraud. If we cancel an order after you have paid, we will refund you in full to your original payment method. If we discover a pricing error that affects your order, we will contact you before dispatch and give you the choice to proceed at the correct price or cancel for a full refund. Price changes do not affect orders already accepted.
Payments are processed through Shopify's secure checkout and its payment processors. We do not see or store your full card details.
6. Shipping, returns and refunds
Shipping destinations, timing, costs and delivery terms are governed by our Shipping Policy. Returns, exchanges, cancellations and refunds are governed by our Returns & Refunds Policy. Both policies form part of these terms.
We bear the risk of loss or damage to a product until it is delivered to the address you supplied. Delivery estimates are not guaranteed arrival dates.
7. Intellectual property and submitted content
The Site, including its design, text, images, artwork, logos, graphics and other content, is owned by or licensed to Kato Creations and is protected by intellectual property laws. You may view and print content for your personal, non-commercial use. You may not copy, reproduce, modify, distribute or use our content for commercial purposes without our written permission.
If you send us feedback or other content, you confirm that you have the right to provide it and that it is lawful. You allow us to use feedback without restriction or payment. We handle personal information in accordance with our Privacy Policy.
8. Disclaimers
Products are covered by any warranties that apply under the law of your state, including implied warranties that cannot be excluded. Except for those rights and any express statements in our policies, and to the extent permitted by law, the Site and products are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
9. Limitation of liability
To the extent permitted by law, Kato Creations and its service providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site or products. To the extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for that product.
These limits do not apply to liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct where state law does not allow it to be limited. Some states do not allow the exclusion or limitation of incidental or consequential damages, so these limits may not apply to you.
10. Your legal rights
Nothing in these terms limits or excludes any consumer right or protection that applies to you by law and cannot legally be limited or excluded. Where applicable consumer law gives you rights that conflict with these terms, those rights prevail.
11. Governing law
These terms are governed by applicable law. However, if you are a consumer, nothing in these terms removes or limits the protection of the mandatory consumer protection laws of the state or country where you live, and you may bring a claim in the courts of your home state or any other court with jurisdiction. These terms do not require arbitration and do not waive your right to take part in a class action.
12. Changes, severability and contact
We may update these terms from time to time. The "Last updated" date above shows the latest revision. The terms in effect when you place an order apply to that order.
If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. Checkout, payments and delivery are provided by Shopify, its payment processors and shipping carriers, whose own terms may also apply.
